Information on the processing of personal data in the context of communication via WhatsApp Business
The protection of your personal data is our highest priority and is taken into account in all our business processes. Personal data means any information relating to an identified or identifiable natural person. With this data protection notice, we inform you about the nature, scope and purposes of the collection of personal data by the Adecco Group Switzerland and how we handle such data. 1. What data do we process, for what purpose is the data processed and on what legal justification is this based?
The processing of personal data via WhatsApp Business is carried out exclusively for the purposes of business communication and the provision of our services. This includes in particular establishing contact and coordinating with candidates, employees, clients and other business partners, responding to enquiries, sharing relevant information as well as appropriately documenting communication in the context of our business activities.
As part of communication via WhatsApp Business, we may process personal data such as:
- Last name, first name
- Mobile phone number
- Content of messages
- Transmitted attachments
As a matter of principle, we do not request special categories of personal data via WhatsApp Business. Should such data nevertheless be transmitted, it will only be processed within the limits permitted by law and with the application of appropriate protective measures.
Processing based on your consent
The processing of your personal data is carried out on the basis of your consent. By communicating with us via WhatsApp or by consenting to being contacted via WhatsApp, you agree to the processing of your personal data for the purposes mentioned above. You may revoke your consent at any time vis-à-vis the controller with effect for the future. The revocation of consent does not affect the lawfulness of the processing carried out until the time of revocation.
Processing in the context of the employment relationship
The processing of your personal data takes place in the context of communication via WhatsApp Business for the performance and administration of the existing employment relationship. The use of WhatsApp Business is voluntary and merely constitutes an optional communication channel. For this purpose, we process in particular your name, contact details and the content of messages exchanged via WhatsApp, insofar as this is necessary for work-related coordination, organisational information and other business-related communication. Alternativel communication channels are available to you at all times.
Processing on the basis of legal requirements
Furthermore, we process your data insofar as this is necessary for the assertion of legal claims and for defence in legal disputes and is required for the fulfilment of legal obligations.
Processing on the basis of an overriding interest
In addition, we process your personal data insofar as this is necessary to safeguard our overriding interests or those of a third party. For the administration of the contractual relationship, we have an overriding interest in processing the data in order to ensure compliance with internal policies and procedures and to fulfil contractual obligations.
2. Is my data disclosed to thirs parties?
WhatsApp Business is operated by WhatsApp LLC, a Meta Platforms, Inc. company. WhatsApp processes personal data under its own responsibility for certain processing operations in accordance with its own privacy policy and terms of use. Since WhatsApp is based in the United States, data can be transferred to the USA. 3. How long is my data stored?
We process and store your personal data only for as long as we need it to fulfil contractual, legal or internal procedural obligations. If the processing is based on your consent and you revoke it, your data will be deleted at the time of revocation.
4. What rights do I have as a data subject?As a data subject, you have the right of access pursuant to Art. 25 FADP. You also have the right to request the deletion of your personal data – unless statutory retention obligations preclude this – as well as the right to request the surrender the thereof pursuant toArt. 28 FADP.
